Membership Terms and Conditions - Dead Poets 

 

1. Introduction

Welcome to Dead Poets. By becoming a member of the Dead Poets, you agree to comply with and be bound by the following terms and conditions. Please read these terms carefully before joining the Dead Poets. The following terms and conditions are applicable between the person
('Member') and Dead Poets (org nr 927 606 747). These terms and conditions are an integral part of the Membership Agreement. In addition to specific terms and conditions that may, at any time, apply to other services and offers. These terms and conditions are available on our website. https://www.deadpoets.no/

 

2. DEAD POETS MEMBERSHIP

2.1. Dead Poets membership can be taken out by persons over the age of 20
who:
2.1.1. Does not have any outstanding debt associated with a previous Dead Poets membership.
2.1.2. Has not previously been banned from Dead Poets.
2.1.3. Has not acted negligently in connection with a previous Dead Poets membership.
2.2. Membership is valid from the date of registration.
2.3. Membership in Dead Poets is a continuing agreement, irrespective of the binding period. At the end of the binding period, membership shall continue
until membership is ended, in accordance with chapter 6.
2.4. Membership is personal and may not be transferred or used by anyone other than the member.
2.5. Membership entitles the Member to make use of available offers in accordance with the applicable terms.
2.6. Dead Poets will not always be able to guarantee available space in the venue or at events etc., where the number of guests or access is limited.

2.7. Dead Poets will, as far as possible, adapt its offers and opening hours in line with the members preferences. Dead Poets can be closed or open with reduced opening hours in connection with public holidays, maintenance work or Force Majeure.
2.8. Camera surveillance has been installed in Dead Poets' premises.

3. MEMBERSHIP PAYMENT

3.1. Members pay a monthly, semi-annually, or annually fee and any other fees in accordance with Dead Poets´ applicable prices.
3.2. The fee is payable at the time agreed on a rolling basis, and in exceptional cases on joining, where specific terms and conditions apply. Members are liable for ensuring that membership fees are paid on time and must contact Dead Poets if a payment request is not received.
3.3. If the member does not pay by the due date, regardless of payment method, a debt collection notice will be issued with a new due date. In the event of late payment, Dead Poets has the right to claim costs and interest in accordance with the debt collection act, the overdue payment interest act and other applicable legislation.
3.4. If the Member has otherwise defaulted on payment and receives a payment reminder, debt collection notification or debt collection demand from an
external debt collection agency, the payment details stated in the invoice from the external debt collection agency is to be used for payment.

3.5 Available payment methods are Stripe (credit card), PayPal and Vipps

4. MEMBERSHIP RESPONSIBILITIES

4.1. The Member undertakes to:
4.1.1. Familiarize themselves with Dead Poets Safety Rules and Code of Conduct (general) and other Safety Rules and Codes of Conduct, which are
available on our website https://www.deadpoets.no/
4.1.2. Members shall notify Dead Poets of any change of contact details/payment information, including change of name, address, email address,
phone number, account number and any other relevant information. Such notification is to be given without undue delay.
4.1.3. Register on arrival before Members use the premises. Dead Poets has the right to ask the Member to show ID.

4.2. Members must conduct themselves in a professional and respectful manner at all Dead Poets events and activities.
4.3. Harassment, discrimination, or any form of disrespectful behavior will not be tolerated and may result in immediate termination of membership.
4.4. Members cannot use any drugs or substances that are illegal.

5. DATA PROTECTION AND COMMUNICATION

5.1.  Dead Poets will process personal data about the Member in connection with the membership. Information about how Dead Poets process personal data about the Member and the Member's data protection rights, is included in our privacy policy https://www.deadpoets.no/
5.2. For sending general information about the membership, we will primarily use the email or postal address that the Member has provided to us.

 

6. TERMINATION AND MODIFICATION OF MEMBERSHIP AGREEMENT

6.1. The Member has the right to terminate the Membership Agreement (right to cancellation) by notifying Dead Poets within two (2) weeks of signing of the
Membership Agreement, cf. the cancellation act § 20. The Member can use the cancellation form that is available per request - contact hello@deadpoets.no. When using the right to cancellation, prepaid fees will be refunded. The Member is required to document that the right to cancel has been exercised in accordance with applicable legislation.
6.2. Membership may be terminated at any time after the end of the binding period. At the end of the binding period, the membership turns into an ongoing
agreement in accordance to clause 2.3. The notice period is one (1) month, and termination will take effect at the end of the following month.
6.3. The termination of a membership can be administered by the Member through the personal profile on deadpoets.no LINK. Alternatively, the Member
can give notice to Dead Poets via e-mail, contact form, letter or phone, or in Dead Poets in person. Dead Poets will confirm, by email or letter, that notice to
terminate has been received, within two (2) weeks of receipt of such notice. The Member must be able to document that notice to terminate has been given.
6.4. Dead Poets has the right to amend membership fees, other fees and terms and conditions.

6.4.1. When amending membership fees, Dead Poets reserves the right to an annual price adjustment in respect of ongoing agreements based on the
consumer price index, without prior notification. In the event of other price changes, Dead Poets is to provide at least one (1) months’ notice in advance by
email/SMS. The price change will take effect one (1) month after the notification has been sent, calculated from the first month of change.

7. INTELECTUAL PROPERTY

7.1 Any content or materials provided to members as part of Dead Poets activities are protected by intellectual property laws and are for personal use only.
7.2 Members shall not reproduce, distribute, or share Dead Poets materials without prior written consent. 

8. LIMITATION OF LIABILITY

8.1 Dead Poets is not liable for any loss, injury, or damage incurred as a result of participation in Dead Poets activities.
8.2 Members participate in Dead Poets activities at their own risk.

9. GOVERNING LAW AND JURISDICTION

9.1 These terms and conditions shall be governed by and construed in accordance with the laws of Norway.
9.2 Any disputes arising from membership, or these terms shall be subject to the exclusive jurisdiction of the courts of Norway with Oslo courthouse as first legal proceeding. 

9.3 Complaints must be addressed to the seller within a reasonable time. The parties must try to resolve and disputes amicably. If this is not successful, the buyer can contact the Norwegian Consumer Protection Authority for mediation. Forbrukertilsynet is available on phone 23 400 600 or  www.forbrukertilsynet.no

9.4 The European Commission's complaints portal can also be used if you wish to lodge complaint. It is particularly relevant if you are a consumer living in another EU country. The complaint is filled here http://ec.europa.eu/odr

10. AMENDMENTS

10.1 Dead Poets reserves the right to modify or amend these terms and conditions at any time.

10.2 Members will be notified of any changes, and continued membership constitutes acceptance of the modified terms.

By becoming a member of Dead Poets, you acknowledge that you have read, understood, and agree to these terms and conditions.
